Terms of Service

1. Acceptance of Terms & Scope

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “Registrar,” “Developer,” or “Visitor”) and WITH YOU MEDYA GIDA SANAYİ VE TİCARET LİMİTED ŞİRKETİ (“Company,” “With You Global,” “we,” “us,” or “our”), the applicant and proposed registry operator for generic Top-Level Domains (gTLDs) including .DEPLOY and .ATLAS under the Internet Corporation for Assigned Names and Numbers (ICANN) New gTLD Program Next Round.

By accessing or using withyouglobal.com, registry APIs, Registration Data Access Protocol (RDAP) endpoints, the Operational Test & Evaluation (OT&E) environment, registrar documentation, or any associated digital services (collectively, the “Services”), you acknowledge that you have read, understood, and agree to be bound by these Terms and our related policies.

2. ICANN Consensus Framework & Registry Relationship

With You Global operates in strict adherence to the multi-stakeholder governance model and consensus policies established by ICANN. Nothing in these Terms shall supersede or contradict:

• The ICANN Base Registry Agreement (RA) and its relevant Specifications (including Specification 10 Service Level Agreements and Specification 11 Public Interest Commitments).
• The standardized Registry-Registrar Agreement (RRA) executed between With You Global and ICANN-accredited registrars.
• ICANN consensus policies, including the Uniform Domain-Name Dispute-Resolution Policy (UDRP), the Uniform Rapid Suspension (URS) system, and Temporary Specifications for gTLD Registration Data.

3. Permitted Use & Automated Access Restrictions

Our web portals, APIs, and directory services are provided to facilitate domain lookups, registrar onboarding, technical integration, and public interest transparency. When utilizing our Services, you agree NOT to:

• Engage in high-volume, automated, or scripted queries against our RDAP or WHOIS services to harvest, scrape, compile, or distribute registrant data for commercial marketing, solicitation, or unauthorized profiling.
• Attempt to compromise, probe, scan, or breach the security or authentication measures of any With You Global network, server, EPP gateway, or DNS nameserver constellation.
• Launch denial-of-service (DoS/DDoS) attacks, flood requests, or artificially consume bandwidth that disrupts registry infrastructure stability.
• Use our Services or trademarks to transmit unsolicited bulk email (spam), distribute malware, operate botnet Command & Control (C2) nodes, or execute phishing campaigns.

We reserve the right to throttle, rate-limit, or permanently blacklist IP addresses and CIDR ranges that violate these querying and operational security thresholds.

4. Operational Test & Evaluation (OT&E) Environment

Access to our OT&E testing environment (available to ICANN-accredited registrars and vetted infrastructure partners) is provided solely for software validation, EPP/RDAP interoperability testing, and operational readiness. Data entered into the OT&E environment carries no property right, is periodically purged, and confers no priority in Sunrise or General Availability registrations. You are solely responsible for maintaining the confidentiality of OT&E testbed credentials.

5. Intellectual Property & Brand Assets

All content, technical diagrams, software code, logos, brand assets, and textual materials published across our Services are the proprietary intellectual property of WITH YOU MEDYA GIDA SANAYİ VE TİCARET LİMİTED ŞİRKETİ, protected by Turkish and international copyright and trademark laws. Use of our official brand marks, 512×512 PNG logos, and vector assets must adhere strictly to the guidelines specified in our Media Kit.

Domain names registered under our TLD namespaces are subject to mandatory Rights Protection Mechanisms (RPMs), including the Trademark Clearinghouse (TMCH), Sunrise priority verification, and Trademark Claims notices.

6. Service Level Commitments & Disclaimers

For our delegated registry namespaces, technical availability and DNS performance are governed by ICANN Specification 10 benchmarks (100% DNS resolution availability, 99.95% RDAP uptime, and 99.5% EPP gateway uptime).

Except as expressly established under binding ICANN Registry Agreements or written Service Level Agreements, our informational web portals and digital services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied.

7. Limitation of Liability & Indemnification

To the maximum extent permitted by applicable law, WITH YOU MEDYA GIDA SANAYİ VE TİCARET LİMİTED ŞİRKETİ, its officers, directors, employees, and technical affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or operational interruption arising out of your access to or inability to use the Services.

You agree to indemnify, defend, and hold harmless With You Global and its personnel from and against any claims, liabilities, damages, losses, or legal costs arising out of your breach of these Terms, unauthorized system access, or violation of third-party rights.

8. Governing Law & Dispute Resolution

These Terms and any dispute arising from or related to the Services shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of law principles.

The Central Courts and Enforcement Offices of Istanbul (İstanbul Adliyesi, Çağlayan / Anadolu) shall have exclusive jurisdiction over any litigation arising between the parties, without prejudice to mandatory dispute resolution frameworks governed by ICANN (including UDRP, URS, PDDRP, and RRDRP).
